WARRANTY CONDITIONS AND EXCLUSIONS
The warranties shall not apply if the failure is caused by abnormal external influences including but not limited to mechanical abrasion; falling objects; explosion; fire; riots; acts of war; terrorism; radiation; harmful chemicals or fumes; temperatures in excess of 110°C; water chemicals and foreign substances; excessive salt atmospheres or deposits; direct and continuous exposure to rainwater; failure from post formed or post fabrication processes and any other circumstances beyond Panther Protect’s reasonable control. The warranties shall not apply if the residential building is less than 100 metres from salt water.

LIABILITY
Panther Protect’s liability shall be limited to the actual cost of repairing, the defective metal or replacing the product at Panther Protect’s discretion, which shall constitute Panther Protect’s sole liability and the claimant’s sole remedy (whether at law or in equity or otherwise and including for negligence). In no event shall Panther Protect be liable for any further direct, incidental, special, or consequential damages.
The cost of repair or replacement shall be determined by Panther Protect using contractors, materials and practices selected by it. Panther Protect will determine, at its reasonable discretion, the most appropriate materials and practices for remedying the failure. Subject only to any overriding law (statutory or otherwise) to the contrary, Panther Protect shall not be liable for any representation or statement made by or on behalf of it whether made prior to or after the giving of this Performance Warranty. Panther Protect’s liability will be solely derived from the terms of this Performance Warranty.
